1. Agreement to these terms
These Terms of Service (“Terms”) govern your use of digicadia.com (the “Site”) and your purchase of digital products (the “Products”) from Digicadia (“Digicadia”, “we”, “us”). By using the Site or buying a Product, you agree to these Terms. If you do not agree, please do not use the Site or buy Products.
You must be at least 18 years old to buy a Product.
2. Our Products
We sell digital products such as ebooks, guides, programs, templates, and courses. They are delivered electronically, and no physical item is shipped. Each Product is described on its sales page.
After your purchase, the payment platform (such as Hotmart) sends a download or access link to the email address you provided at checkout. Please make sure it is correct. If you do not receive the email, check your spam folder and then contact us at help@digicadia.com.
Photographs and illustrations on the Site and in the Products may be generated with artificial intelligence and are for illustrative purposes only. Unless stated otherwise, they do not depict real customers.
3. Informational content and your responsibility
The Products are for educational and informational purposes only. They are not medical, nutrition, fitness, legal, financial, or other professional advice, and they do not replace the advice, diagnosis, or treatment of a qualified professional.
If a Product covers health, nutrition, or exercise, consult your doctor or a qualified professional before starting, especially if you have a pre-existing medical condition, are pregnant, are breastfeeding, or have any doubts about your physical condition. If you feel joint pain (as opposed to normal muscle fatigue), stop and consult a professional before continuing.
Results vary from person to person and depend on many factors, including your starting point, effort, and consistency. We do not guarantee any specific result. You use the Products at your own risk and are responsible for adapting them to your own needs, allergies, and restrictions.
4. Purchases and payment
Purchases are made through the checkout of a third-party platform, such as Hotmart. That platform processes your order and payment on our behalf, and its own terms and privacy policy also apply to your purchase.
The price is shown at checkout before you pay. Prices are listed in U.S. dollars unless the checkout shows otherwise, and the platform may display the price converted to your local currency. Taxes or payment-provider fees may apply depending on your location.
If a Product is offered as a subscription or with recurring payments, the billing frequency and how to cancel are shown at checkout. To avoid the next charge, cancel before the next billing date.
5. Refunds
Each Product has a money-back guarantee period stated on its sales page or at checkout. If none is stated, the guarantee is 7 days from purchase. If you are not satisfied, you can request a full refund within that period by following the refund instructions in your platform purchase email or by contacting us at help@digicadia.com.
Refund requests made after the guarantee period may be declined. Refunds are returned to the original payment method, and the time it takes to appear depends on your bank or card issuer.
6. License and permitted use
When you buy a Product, we give you a personal, limited, non-exclusive, non-transferable license to download and use it for your own personal, non-commercial use, unless the Product’s page says otherwise.
You may not, without our written permission:
• copy, reproduce, distribute, resell, share, or publish a Product, in whole or in part, in any form;
• post a Product or its contents online, including in social media groups, forums, or file-sharing sites;
• modify a Product or use it to create products or services that you sell or offer to others.
You may print a Product for your own personal use.
7. Intellectual property
The Products, the Site, and all of their content, including text, plans, templates, images, graphics, names, and logos, are owned by Digicadia or its licensors and are protected by copyright and other intellectual property laws. Except for the license in Section 6, we do not grant you any rights to them.
8. Acceptable use of the Site
You agree not to misuse the Site. This includes attempting to gain unauthorized access, interfering with its operation, using automated tools to copy its content, or using it for any unlawful purpose.
9. Third-party services and links
The Site links to third-party services such as payment platforms, Instagram, and Facebook. We do not control them and are not responsible for their content or practices.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Site and the Products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Digicadia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or the Products, including any injury or health problem related to diet or exercise. Our total liability for any claim relating to a Product will not exceed the amount you paid for that Product.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Privacy
Our Privacy Policy (https://digicadia.com/privacy-policy) explains how we collect and use your personal information.
13. Governing law and disputes
These Terms are governed by the laws of Chile, without regard to conflict of laws rules. If you are a consumer, nothing in these Terms removes mandatory consumer protections that apply to you under the laws of the place where you live.
If you have a problem with your purchase, please contact us first at help@digicadia.com. We will do our best to resolve it quickly and in good faith.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms. Changes do not apply to purchases made before the change.
